Domestic violence covers a wide range of criminal offenses that involve cohabitants of the same residence. Three common charges that fall under domestic violence are assault, criminal mischief, and domestic violence in the presence of a child. Quite often, all three of these are charged at the same time for one incident. Simply put, domestic violence assault is when there has been any unwanted physical touching, i.e. hitting, pushing; criminal mischief is when there has been damage to personal property, i.e. broken cell phone, punched hole in the wall; and domestic violence in the presence of a child is when the incident occurs while a child is present, even when the child is in another room and was oblivious to the incident.

Depending on the seriousness of the allegations (injury, weapons, prior convictions), domestic violence can be charged as a misdemeanor or felony. A misdemeanor may result in jail time for one year or less, while a felony may result in prison time for one year or more.
